Terms of Service

1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the DroneEye platform ("Platform"), operated by DroneEye ("we", "us", "our"). By registering an account or using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, do not create an account or use the Platform.
2. Eligibility
You may use the Platform only if:
- You are at least 18 years of age.
- You have the legal capacity to enter into a binding contract.
- You are not prohibited from using the Platform under applicable law.
- You provide accurate, complete, and up-to-date information during registration.
- If registering as a Pilot, you hold all valid drone operator certifications, licences, and permits required by the jurisdiction(s) in which you intend to operate.
- If registering as a Pilot, you maintain adequate and current liability insurance covering drone operations, where required by applicable law.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorised use of your account. We are not liable for any loss resulting from unauthorised access caused by your failure to safeguard your credentials.
You may not create an account on behalf of another person without their explicit consent, or use another person's account.
4. User roles
The Platform operates with distinct roles:
- Clients — organisations or individuals who post missions and hire pilots.
- Pilots — drone operators who apply to missions and deliver aerial services.
- Admins — DroneEye staff who maintain the Platform.
Each role has defined permissions within the Platform. You may not attempt to exercise the permissions of a role you have not been granted.
5. Missions
Clients are responsible for the accuracy and lawfulness of mission briefs they post. Missions must not require activities that violate applicable law, including airspace regulations.
Pilots are solely responsible for ensuring they hold all required licences, certifications, and insurance before accepting or executing a mission. DroneEye does not verify, validate, or guarantee the accuracy, authenticity, validity, or legal sufficiency of any pilot's qualifications, certifications, licences, insurance, experience, or equipment. Users rely on information provided by other users entirely at their own risk.
DroneEye is not a party to any agreement, contract, or arrangement between clients and pilots. DroneEye does not guarantee that any mission will be completed, performed to any standard, or delivered on time. Disputes between clients and pilots regarding mission outcomes, deliverables, quality, or payment are solely between the parties involved. DroneEye provides a communication channel but assumes no responsibility for the outcome of any mission or any interaction between users.
Pilots who apply for or accept any mission represent and warrant that they: (a) hold all certifications, licences, permits, and authorisations required by the competent aviation authority and any other relevant governmental body in the jurisdiction where the mission will be performed; (b) have obtained specific permission to operate in any restricted, controlled, or otherwise regulated airspace applicable to the mission; (c) maintain valid and adequate liability insurance that covers the specific mission, including but not limited to third-party property damage, personal injury, and bodily harm; and (d) are in full compliance with all applicable local, national, and international regulations governing unmanned aircraft systems (UAS) operations. Each mission application constitutes a legally binding affirmation of the foregoing.
Pilots bear sole, exclusive, and unconditional responsibility for verifying the legality of every flight they undertake. This includes, without limitation, verifying airspace classifications, obtaining Notices to Airmen (NOTAMs), securing temporary flight restrictions or authorisations, complying with geofencing and altitude restrictions, and adhering to all rules set by the relevant civil aviation authority (e.g., EASA, FAA, CAA, or local equivalents). DroneEye does not monitor, verify, or assess airspace status, flight legality, or regulatory compliance of any pilot or mission.
Operating an unmanned aircraft in restricted or prohibited airspace without valid authorisation from the competent authority constitutes a serious regulatory offence and may result in criminal prosecution, substantial fines, civil liability, equipment confiscation, and revocation of operating licences. DroneEye explicitly disclaims any and all liability for incidents, accidents, damages, injuries, deaths, regulatory penalties, or any other consequences arising from a pilot's failure to obtain proper authorisation, maintain valid certifications, or carry adequate insurance. Pilots agree to indemnify and hold harmless DroneEye from all claims, losses, damages, and expenses (including legal fees) arising from unauthorised or non-compliant flight operations.
6. Prohibited conduct
You must not use the Platform to:
- Post false, misleading, or fraudulent information.
- Upload documents that are forged, expired, or do not belong to you.
- Harass, threaten, or abuse other users.
- Circumvent the Platform to conduct transactions off-platform with users you first contacted through the Platform.
- Attempt to gain unauthorised access to any part of the Platform or another user's account.
- Introduce malicious code, viruses, or automated scripts into the Platform.
- Post missions that require illegal activities or operations in restricted airspace without authorisation.
7. Content and intellectual property
You retain ownership of content you upload to the Platform (e.g. portfolio images, documents, mission descriptions). By uploading content, you grant DroneEye a non-exclusive, worldwide, royalty-free licence to store, display, and process that content solely for the purpose of operating the Platform.
DroneEye retains all intellectual property rights in the Platform itself, including its design, code, and branding. You may not copy, reverse-engineer, or create derivative works of the Platform.
8. Reviews
Reviews submitted through the Platform must be honest and based on your direct experience. You may not submit reviews in exchange for compensation, post reviews for missions you were not involved in, or attempt to manipulate ratings.
Reviews are permanent and public once submitted. DroneEye may remove reviews that violate these Terms or that contain personal information, hate speech, or defamatory content.
9. Termination
We may suspend or permanently deactivate your account if you violate these Terms, without prior notice in cases of serious violations. You may deactivate your own account at any time by contacting us.
On termination, your right to access the Platform ceases immediately. Sections that by their nature survive termination (including 7, 10, and 11) remain in effect.
10. Disclaimers and limitation of liability
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. DroneEye expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
DroneEye does not guarantee, represent, or warrant that: (a) any mission posted on the Platform will be completed, fulfilled, or performed to any standard; (b) any information provided by users — including pilot qualifications, certifications, licences, insurance, experience, equipment specifications, or mission descriptions — is accurate, truthful, complete, or up to date; (c) any pilot is suitable, qualified, or legally authorised to perform any specific mission; (d) the Platform will be available without interruption, error, or delay; or (e) any particular result or outcome will be achieved through use of the Platform.
DroneEye operates solely as an online marketplace that connects clients with drone pilots. DroneEye is not a party to any agreement, contract, or arrangement between clients and pilots. DroneEye does not employ, supervise, direct, or control any pilot. All missions are performed by independent third-party operators entirely at their own risk and responsibility.
To the maximum extent permitted by applicable law, DroneEye, its officers, directors, employees, agents, and affiliates shall not be liable for any damages whatsoever, including but not limited to: direct, indirect, incidental, special, consequential, punitive, or exemplary damages; loss of profits, revenue, data, or business opportunities; property damage; personal injury or death; emotional distress; or any other losses arising from or related to: (i) your use of or inability to use the Platform; (ii) any mission conducted, arranged, or discussed through the Platform; (iii) any act, omission, negligence, misconduct, or misrepresentation by any user; (iv) any equipment failure, malfunction, or accident; (v) any violation of applicable law by any user; or (vi) any other matter relating to the Platform — regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if DroneEye has been advised of the possibility of such damages.
You acknowledge and agree that you use the Platform and participate in any mission entirely at your own risk. You agree to indemnify, defend, and hold harmless DroneEye and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or any mission in which you participate.
Without limiting the generality of the foregoing, DroneEye shall bear no liability whatsoever for any incident, accident, property damage, personal injury, death, environmental damage, regulatory penalty, fine, sanction, or any other loss or consequence arising from or related to: (a) a pilot operating in restricted, prohibited, or controlled airspace without the required authorisation; (b) a pilot operating without valid certifications, licences, or permits; (c) a pilot operating without adequate or current insurance coverage; (d) a pilot's failure to comply with any applicable aviation regulation, airspace restriction, or governmental requirement; or (e) a client's failure to verify the credentials, qualifications, or regulatory compliance of a pilot before engaging their services. Both pilots and clients acknowledge and agree that DroneEye, as a technology platform and marketplace intermediary, has no duty, obligation, or ability to verify airspace authorisations, pilot credentials, insurance coverage, or regulatory compliance, and bears no responsibility for the consequences of any user's failure to comply with applicable law.
11. Governing law
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict of law principles. Any disputes arising from these Terms or the Platform will be resolved in the courts of Belgrade, Serbia, unless otherwise required by mandatory consumer protection law in your country.
12. Changes to these terms
We may update these Terms from time to time. We will notify registered users of material changes via email or in-platform notification at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
